Model Aircraft and Oregon State Law
In 1997 Oregon aircraft modelers banded together to develop and introduce an amendment to the Oregon land use law which would enable aircraft modelers living in Oregon to have a place, recognized by law, where we could fly our models. Senator Bill Fisher, Roseburg, sponsored this bill for us - Senate Bill 395. Senate Bill 395, amended ORS 215 in two places by adding another paragraph to ORS 215.213, Marginal Use Lands, section (x)(w in the 2005 version), and to ORS 215.283, Non-marginal Use Lands, section (u)(t in the 2005 version). Note these are placed in the law so that we are NOT subject to ORS 215.296, which would require us to get a conditional use permit. Model aircraft flying is an outright permitted use on Exclusive Farm Use land subject to the conditions written into the law itself. Needless to say, we owe a big debt of gratitude to Senator Fisher and the other senators and representatives who championed our cause.
